Terms of Use

The rules of the road.

These terms govern your use of De Kind. By creating an account or using the service, you agree to them. Read them carefully — they limit our liability and define what you can and can't do.

Agreement

These Terms of Use ("Terms") form a binding agreement between you ("you", "your") and Nexus-Sectech Ltd, a company registered in England and Wales (Company No. 17126982) ("we", "us", "De Kind").

By creating an account or using De Kind, you confirm that you are at least 18 years old, you have legal capacity to enter this agreement, and you accept these Terms in full.

If you don't agree to these Terms, you may not use De Kind.

Your account

To use De Kind, you create an account with a verifiable email address. You are responsible for:

  • Keeping your password confidential — we will never ask for it
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorised access
  • Providing accurate information at registration and keeping it up to date

You may only operate one account at a time. Creating multiple accounts to circumvent restrictions (e.g. free-tier limits) is prohibited.

Acceptable use

You agree to use De Kind only for its intended purpose: maintaining a shared co-parenting record with one other parent. You agree not to:

  • Use De Kind to harass, intimidate, or coerce the other parent
  • Submit false, misleading, or fabricated entries
  • Attempt to access another household's data
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the service to violate any law or court order
  • Run automated scripts or bots against the service
  • Resell, sublicense, or commercially exploit De Kind without our written permission

Important: De Kind is a record-keeping tool, not a substitute for legal advice, mediation, or court proceedings. If you are in an abusive or coercive relationship, please contact a qualified support service. The UK National Domestic Abuse Helpline is 0808 2000 247.

The shared record

De Kind allows two parents to share a co-parenting record. By participating in a household, you acknowledge:

  • The other parent in your household will see all entries you create
  • Once a request is acknowledged by the other parent, neither of you can edit or delete it (this is enforced cryptographically)
  • Custody logs and cost entries are visible to both parents in real time
  • Either parent can dissolve the household, which removes their access but does not delete the other parent's record

You are responsible for the accuracy of entries you create. Entries you log are attributable to you via cryptographic timestamps, even after you leave a household.

Exports and legal use

De Kind allows you to export your record as a PDF or CSV (Premium feature). Exports are designed to be readable by solicitors, mediators, and family courts.

However, we make no warranty that any specific court, solicitor, or third party will accept a De Kind export as evidence. Whether an export is admissible in any particular proceeding depends on the rules of that proceeding and is at the discretion of the relevant tribunal or party.

You agree not to alter, forge, or modify any De Kind export. The cryptographic structure of the export makes tampering detectable. Submitting a tampered export as evidence may constitute a criminal offence.

Payment and billing

De Kind offers a free tier and a Premium subscription (currently £4.99/month, both parents covered). Premium subscriptions are processed by Stripe Inc., subject to their own terms.

By subscribing, you authorise us (via Stripe) to charge your nominated payment method on a recurring monthly basis until you cancel. Prices include VAT where applicable.

We may change pricing with at least 30 days' notice by email. Existing subscribers will continue at the old price for one full billing cycle after the change before the new price takes effect.

Refunds and cancellation

You can cancel your Premium subscription at any time in Settings → Billing. Cancellation takes effect at the end of the current billing period. You retain Premium features until then.

We don't offer refunds for partial billing periods. If you cancel mid-month, you keep Premium access until your next billing date.

Under the UK Consumer Contracts Regulations 2013, you have the right to a refund if you cancel within 14 days of your first Premium charge, unless you have already used a Premium-only feature (e.g. generated a PDF export). By generating an export, you waive this right.

Intellectual property

De Kind, including the name, branding, design, code, and content, is owned by Nexus-Sectech Ltd and protected by copyright, trademark, and other UK and international IP laws.

You retain ownership of the data you enter into De Kind (custody logs, requests, costs, receipts). You grant us a limited, revocable, non-exclusive license to store, process, encrypt, and display your data for the purpose of operating the service.

We do not claim ownership of your record. If you delete your account, the license to your personal data ends within 30 days (see Privacy → Retention).

Liability

De Kind is provided "as is" and "as available". We do not warrant that the service will be uninterrupted, error-free, or meet any particular legal standard.

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of De Kind is limited to:

  • For free users: £100
  • For Premium users: the total amount you paid us in the 12 months preceding the claim

We are not liable for indirect, consequential, or special damages, including loss of profits, loss of data (beyond restoring from backup), or damage to your reputation or relationships, even if foreseeable.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited under UK law.

De Kind is not a substitute for legal advice. We are not lawyers, mediators, or family court officials. Anything you do with your De Kind record in legal proceedings is your own decision and responsibility.

Termination

You can terminate your account at any time via Settings → Danger zone.

We may suspend or terminate your account if you breach these Terms, if your account is used for abuse, fraud, or harassment, or if we are required to by law. We will give you notice and a chance to respond unless immediate action is required.

On termination, your access ends immediately. Your personal data is deleted within 30 days (see Privacy Policy). Your contributions to a shared household remain anonymised so the other parent's record is preserved.

Changes to these Terms

We may update these Terms occasionally. Material changes will be notified by email at least 30 days in advance. Your continued use after the effective date constitutes acceptance.

If you do not accept the new Terms, you may cancel your account before they take effect.

Governing law and disputes

These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating any formal proceedings, you agree to first contact us at hello@nexus-sec.tech so we have an opportunity to resolve the dispute amicably.
